Q&A – New Apps for Model Releases

Q. I’ve seen those new iphone/ipad apps that allow you to get the model to sign the release directly on the iphone/ipad. The release then can be exported to a PDF and emailed right from the iphone/ipad to the model and photographer for storage/printing. Are these legally binding?

A. As reported in my December 16, 2006 blog entry, each state now has enacted either the Uniform Electronic Transactions Act (UETA) or other statutes that recognize the use of electronic signatures and records in government or business transactions.  It’s always best to use a release that has been written or approved by an attorney who practices in the area.  So take advantage of this new technology and get those releases!
